1. Agreement to Terms

Welcome to Kartopia. These Terms and Conditions (“Terms”) govern your use of the Kartopia website at kartopiala.com (the “Site”) and the services offered by Kartopia Inc. (“Kartopia,” “we,” “us,” or “our”).

By accessing this Site, submitting a booking inquiry, or visiting our facility, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

2. Facility and Services

Kartopia operates an indoor family entertainment center located at 14928 Oxnard St. Van Nuys, CA 91411. Our facility includes:

Indoor go-kart racing
Arcade games
Indoor soft play (for children 8 and under)
Private and reserved event space

Access to our facility, activities, and services is subject to these Terms, our on-site rules, and any additional agreements or waivers signed at the facility.

3. Eligibility

By using the Site or our services, you represent that:

You are at least 18 years old, or you are accessing the Site with the consent and supervision of a parent or legal guardian
All information you submit is accurate and current
You have the legal authority to enter into these Terms

Minors under 18 may use our facility only with a waiver signed by a parent or legal guardian.

4. Booking, Reservations, and Deposits

Party and Event Bookings

Party and event bookings are handled through our concierge process. You submit a request through the Site, and a Kartopia team member contacts you to confirm details and finalize the booking.

A $500 non-refundable deposit is required to hold your event date
Date changes are accepted with at least 2 weeks advance notice, subject to availability
Guest count includes all attendees, including parents, siblings, and non-participants
A 15% service fee applies to all party bookings
Sales tax is not charged on birthday party packages
Gratuity is not included

Walk-In Visits

Walk-in visits do not require a reservation. However, Kartopia may close the facility for private events. We recommend calling ahead or checking our social media to confirm public hours before your visit.

5. Racing Requirements and Safety

Go-kart racing at Kartopia is subject to the following requirements:

Racers must be 36 inches or taller to operate a go-kart
All racers must have a signed liability waiver on file
Waivers for minors must be signed by a parent or legal guardian
Waivers are valid for one year from the date of signing
Racers must wear closed-toe shoes
Kartopia provides helmets, neck guards, sanitized racing suits, and gloves
A one-time $2 helmet liner is required for hygiene
Kartopia staff reserve the right to refuse racing to any guest who does not meet safety requirements or who cannot safely operate the equipment

6. Assumption of Risk and Liability

Go-kart racing, soft play, and arcade activities involve inherent risks, including but not limited to bodily injury, collision, mechanical failure, contact with other participants, and property loss. By using our facility, you voluntarily assume all such risks.

To the fullest extent permitted by law:

Kartopia is not liable for personal injury, property damage, or loss arising from your use of the facility, except in cases of gross negligence or willful misconduct
Kartopia is not liable for lost, stolen, or damaged personal property, including items left in the facility or parking area
You agree to comply with all posted rules, staff instructions, and safety guidelines

Nothing in this section limits liability that cannot be limited under California law.

7. Conduct on the Premises

Kartopia reserves the right to refuse service or remove any guest from the facility for:

Failure to comply with safety rules or staff instructions
Reckless or unsafe behavior on or off the track
Being under the influence of alcohol or drugs
Harassment or threatening behavior toward guests or staff
Damage to property or equipment

Guests who are removed for these reasons are not eligible for refunds.

8. Children and Supervision

Young children must be accompanied by an adult at all times
Kartopia does not provide childcare
Parents and guardians are responsible for their children throughout their visit, including in the soft play area
A Kartopia staff member is present in the soft play area, but this does not transfer supervisory responsibility from parents or guardians

9. Outside Food and Decorations

Outside food and decorations are currently welcome at Kartopia for parties and events. This policy may change. Kartopia will notify booked event holders in advance of any change to this policy. Alcoholic beverages are subject to separate rules and require prior approval.

10. Payment

Accepted payment methods, taxes, and fees will be presented at the time of booking or purchase. Prices and packages are subject to change. Confirmed bookings retain the pricing agreed to at the time of confirmation.

11. Cancellations and Refunds

Party and Event Cancellations

The $500 deposit is non-refundable
Date changes are permitted with at least 2 weeks advance notice, subject to availability

Walk-In Purchases

12. Intellectual Property

All content on the Site — including logos, text, images, video, graphics, and design — is the property of Kartopia or its licensors and is protected by copyright and trademark law. You may not reproduce, distribute, or use any Site content for commercial purposes without prior written permission.

13. User Submissions

If you submit content to Kartopia through the Site — including reviews, photos, testimonials, or inquiry form entries — you grant Kartopia a non-exclusive, royalty-free license to use, display, and reproduce that content for marketing and operational purposes.

14. Website Use

You agree not to:

Use the Site for any unlawful purpose
Attempt to gain unauthorized access to any part of the Site or its systems
Interfere with the Site’s operation
Scrape, harvest, or extract data from the Site without permission
Impersonate any person or entity, including Kartopia staff

15. Third-Party Links

The Site may contain links to third-party websites or services (for example, the online waiver system at kartopiala.aluvii.com). Kartopia is not responsible for the content, policies, or practices of third-party sites. Your use of third-party sites is governed by their own terms.

16. Disclaimer of Warranties

The Site and Kartopia’s services are provided “as is” and “as available.” To the fullest extent permitted by law, Kartopia disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

17. Limitation of Liability

To the fullest extent permitted by law, Kartopia’s total liability to you for any claim arising out of these Terms, the Site, or your use of the facility shall not exceed the amount you paid to Kartopia in the twelve (12) months preceding the claim.

Kartopia is not liable for indirect, incidental, consequential, or punitive damages.

Nothing in this section limits liability that cannot be limited under California law.

18. Indemnification

You agree to indemnify and hold Kartopia harmless from any claim, loss, liability, or expense (including reasonable attorneys’ fees) arising from:

Your breach of these Terms
Your use of the facility or Site
Your violation of any law or third-party right

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles.

Any dispute arising out of these Terms shall be resolved in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.

20. Changes to These Terms

Kartopia may update these Terms at any time. Updated Terms take effect when posted. Your continued use of the Site or facility after changes are posted constitutes acceptance of the updated Terms.
